Cabinet approves establishment of Telecom Tribunal

The Cabinet has approved the Telecom Appellate Tribunal’s establishment to settle disputes in the telecom sector.
The Information Technology and Telecommunication Division informed that Section 7(1) of the Pakistan Telecommunication (Re-Organization) Act, 1996 provides.
It will settle a dispute of a person aggrieved by any decision or order of the Authority. So it is contrary to the provisions of this Act.

He may appeal to the High Court or any other tribunal. But within thirty days of the receipt of such a decision or order.
It will work in the manner prescribed by the High Court for filing the first appeal before that Court, or the tribunal and the Court or the tribunal shall decide such appeal within ninety days.”
Further, Section 22(2) of the Telecom Act, 1996 provides. Suppose the Authority and a licensee cannot agree to a modification to a license condition. Both the Authority and the licensee shall resolve their difference or dispute through consultation and negotiation.
Suppose the licensee and the Authority fail to resolve such differences or disputes amicably. Either party may apply to the High Court or a Tribunal.
The Tribunal shall exercise exclusive jurisdiction to adjudicate and settle all matters connected. It will follow the procedure, as nearly as possible, as provided in the Code of Civil Procedure, 1908 (Act V of 1908)’.

IT ministry had informed that Law & Justice Division In its letter dated 24. 05-2018 stated that under section 7(1) of the Act, 1996/ the Federal Government might establish a Tribunal for this Act’s purpose.
The Establishment of Telecom Appellate Tribunal for Telecom Sector as required under Section 7 & 22 of the Act, 1996 would facilitate smooth and speedy adjudication of cases. It will also help to reduce undue burden on the High Courts across Pakistan relating to Telecom.
