Supreme Court Cancels Rs4.79 Billion Tax on Universal Service Fund
The Supreme Court of Pakistan has annulled a substantial tax demand of Rs4.79 billion placed on the Universal Service Fund (USF), ruling that payments made by USF to telecom operators for services in underserved areas should not be subject to tax deductions under Section 153(2)(b) of the Income Tax Ordinance.
Legal Victory for Universal Service Fund
During the court proceedings, USF presented its case along with supporting evidence explaining its role and objectives in extending telecom infrastructure. The court’s decision to overturn the tax order issued by the tax authorities marks a significant win for USF, enabling it to continue its work unhampered by contentious tax liabilities.
Impact on Telecom Expansion in Remote Areas
The Universal Service Fund is mandated to enhance digital connectivity by providing reliable internet and communication services to Pakistan’s underserved and remote communities. This ruling is expected to accelerate the Fund’s initiatives aimed at expanding high-speed broadband and telecom access across the country’s less connected regions.
The USF termed the judgment as a vital step towards realizing the government’s goals of a “Digital Pakistan” and building a “Digital Nation,” emphasizing its commitment to bridging the digital divide.
Significance for Pakistan’s Digital Future
For Pakistani citizens, especially those in rural and marginalized areas, this development holds considerable importance as it removes financial uncertainties for USF, allowing uninterrupted progress in network expansion and connectivity improvement. Enhanced access to digital services can drive socio-economic growth, education, and access to government services, aligning with national digital transformation priorities.
The USF also acknowledged the guidance and cooperation received from the Ministry of Information Technology and Telecommunication (MoITT) and the Pakistan Telecommunication Authority (PTA) during the legal process.
